Personal project of “Your lawyer”
“Your lawyer” is a service rendered by” HES” law firm
based on contracts signed between the law firm and other
legal entities for solving the employers’ employees’
problems concerning legal issues without taking them
away from their job. The fee for this legal service
is paid by employer.
“HES” law firm’s project of “Your lawyer” is for solving
legal problems of employees not concerning the employer
and other legal problems based on contracts signed between
the law firm and enterprises, offices and organizations
(individually acting entrepreneurs)
This service includes activities such as implementing
persons’ rights, verbal recommendations for solving
legal problems, issuance of written references, preparing
legal documents (references, complaints, etc.) for employers.
A legal service contract is to be concluded between
employer and law firm for implementation of this project.
An agreed service fee is to be determined for every
employer per determined period (6 months, 1 year and
so on). A report is to be issued about rendered service
at the end of each month and about all the services
after liquidation of the contract.
While “Your lawyer” is carried out, the law firm does
not give any advices and documents to employee concerning
any juridical, social and other problems with the employer,
does not act as advisor or negotiator between employer
and employee and doesn’t represent the employer or employee
in state authorities and in courts regarding the issues
between employee and employer.
For implementing the “Your lawyer” project, the employer
is to determine the order of employees with the problems
not concerning the working issues for reception after
working hours. According to that order, special places
and hours is to be determined for reception of employers
either in the company or in the working place. This
order is to be organized in the way that neither employers
working process nor law firm’s normal working activity
be interrupted. For implementation of the project, reception
of employers during nonworking days (holidays, weekends)
is not exempted.
If it is necessary to go away from Baku city for solving
the employer’s juridical problem, the law firm will
organize the solution of that travel and inform the
employer about additional travel allowance. If an employee
is applying to the firm with the problem concerning
the employer, the discussions are stop by the law firm
and the employer is explained about that the project
covers only the problems not concerning the work. The
project covers the issue not envisaged in labor contract
and services for which is paid by the employer. The
law firm can not help the employee in issues covered
in labor contract as a legal service renderer to the
employer. In such cases, the law firm may advice the
employee to apply the employer and trade union organization.
The following are not advisable to parties to do while
implementation of the project:
- While solving the employee’s problems not concerning
work, it is determined by the law firm that, the law
firm has served other party based on previously concluded
contract and that party is a party in this case;
- If there was or occurs any problems between the
law firm and the employee not concerning the project;
- If while implementation of the project, the employee
has had a problem with persons with whom the employer
signed contract and there is no agreement between
the employer and that person on solving this problem
- If the dispute are directly connected to either
the employer or the legal company.
